Terms of Service

• You must be at least 18 and the parent or legal guardian of any child whose photo you upload.
• You own the photos and details you upload. You grant us a limited license to use them to make your book, and nothing else.
• The books we create are for personal, non-commercial use — read them, print them, share them with family.
• Printed book orders are made to order, so they're generally non-refundable — but we'll replace any book that arrives defective or damaged.
• AI generation isn't perfect. If a book turns out badly, contact support@inklingbooks.app and we'll regenerate or refund as appropriate.

By using Inkling you confirm that you are at least 18 years old and have the legal authority to enter into these terms. If you upload a photo or provide information about a child, you confirm that you are that child's parent or legal guardian and that you are authorized to share their image and details with us for the purpose of creating a book.

Inkling is intended for personal, family use. It is not designed for use by children directly.

You are responsible for keeping your sign-in credentials confidential and for any activity that occurs under your account. Notify us promptly at support@inklingbooks.app if you believe your account has been used without your authorization.

You retain all rights to the photos, names, dedications, and other information you submit (“Your Content”). When you upload Your Content, you grant Inkling a worldwide, royalty-free, non-exclusive license to host, process, and use it solely to provide the service to you — that is, to generate your book's illustrations, story, and printed copy.

By uploading Your Content you represent and warrant that:

• You own or have permission to use what you upload.
• For any photo of a child, you are that child's parent or legal guardian, or have explicit permission from one.
• Your Content does not infringe anyone's rights and is not unlawful, abusive, harassing, hateful, or sexually explicit.

When your book is generated, Inkling grants you a perpetual, worldwide, non-exclusive, non-transferable license to:

• Read and re-read the digital preview from your account.
• Order printed copies for personal or family use.
• Share the printed book or PDF privately with friends and family.

You may not resell, mass-distribute, or commercially exploit the generated book or its illustrations. The visual style, layout templates, and underlying technology remain the property of Inkling and our licensors.

You agree not to:

• Upload photos of any person without the legal authority to do so (including children you are not the parent or guardian of).
• Submit content that is unlawful, obscene, defamatory, harassing, hateful, or infringing.
• Attempt to bypass rate limits, scrape the service, reverse-engineer the generation pipeline, or use automation to create books in bulk.
• Use Inkling to create deceptive, identity-fraud, or impersonation material.

We may remove content and suspend or terminate accounts that violate these rules.

The digital preview is free. Printed book prices are shown at checkout in U.S. dollars and processed by Stripe. The price displayed at checkout is the price you pay for that order; we may change prices for future orders without notice.

Printed books are made to order — they don't exist until you place the order. Because of that:

• Once printing has begun, sales are final and we cannot accept returns for change of mind.
• If a book arrives damaged, defective, or with a printing error, contact support@inklingbooks.app within 30 days of delivery with photos and we will arrange a free replacement.
• If you have a serious quality issue with the digital book itself (broken illustrations, the wrong child) before ordering a printed copy, contact us and we'll regenerate it.

Printed book orders are produced and shipped by Lulu Direct, our print-on-demand partner. Estimated production and shipping times are shown at checkout but are estimates, not guarantees.

If a shipment is lost in transit, contact us and we'll work with Lulu to either reship or refund. Shipping risks transfer to you on delivery to the address you provide; please double-check the address before placing your order.

Inkling uses AI models — Anthropic's Claude for the story text and Fal.ai's image-generation models (FLUX with PuLID) for the illustrations — to compose each book. AI output:

• Is a creative interpretation, not a photographic likeness. The illustrated character is meant to evoke your child, not to be a portrait.
• Can occasionally produce unexpected results, visual artifacts, or text that doesn't fit the story.
• Is generated on a best-effort basis and may not always meet your expectations.

If you're unhappy with a generated book, contact us before ordering a print and we'll regenerate it.

We work to keep Inkling available and reliable, but we don't promise it will always be available without interruption. We may modify, suspend, or discontinue features at any time, with or without notice.

You may close your account and request deletion of your data at any time by emailing support@inklingbooks.app. We may suspend or terminate access if you violate these terms or use the service in a way that exposes us, our processors, or other users to liability or harm.

INKLING IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE ERROR-FREE OR MEET YOUR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY LAW, INKLING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR FIFTY U.S. DOLLARS, WHICHEVER IS GREATER.

You agree to indemnify and hold Inkling and its team harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these terms, or your violation of any third party's rights — including intellectual property and privacy rights related to photos or information you upload.

These terms and any dispute arising out of or relating to them or the service are governed by the laws of the State of California, without regard to its conflict of laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute that is not subject to arbitration.

We may update these terms from time to time. If we make a material change, we'll update the “Last updated” date at the top of this page and, where appropriate, notify you by email. Your continued use of Inkling after a change means you accept the updated terms.
